Not only active but also passive smoking is dangerous for health, especially when children are involved. Excessive alcohol consumption has also negative impact on family life. Protecting children from negative consequences of smoking and alcohol consumption is a task not only for its legal guardians but also for the state itself. It was necessary to create proper legal regulations, presented in this paper.
